Terms and conditions of use

Preamble
Harry Hope. is a company specializing in the search, selection, orientation and placement of personnel.
To assist Recruiters in their recruitment process and Candidates in their job search, Harry Hope. provides its users with the website www.harry-hope.com. 

The present General Conditions of Use specify the conditions of use of the Site and the services offered by Harry Hope, whatever the status of the User (Recruiter or Candidate).

For the purposes hereof, the following terms are understood as follows:

  • "User" refers to any person who browses the website, who consults the published information (Candidate and Recruiter).
  • "Candidate" refers to any person looking for a job.
  • " Recruiter " refers to all persons and/or companies wishing to publish information relating to vacancies, on their behalf or that of third parties.  "Service" means the services for putting Recruiters in contact with Candidates, in particular by means of tools for publishing job vacancy announcements, transmitting CVs, etc.
  • "Site" the Internet site accessible at the address www.harry-hope.com and edited by Harry Hope .


Article 1: Acceptance of the "Terms and Conditions of Use".
By accessing the Site and using its services in accordance with the terms and conditions set forth in these General Terms and Conditions of Use (hereinafter "GTCU"), the Visitor acknowledges having read these GTCU and agrees to comply with them without reservation.
These Terms and Conditions are subject to change in order to comply with any new legislative or regulatory provisions. Internet users (Visitors and Users) are therefore advised to regularly refer to the latest version of the "GCU", which is permanently available on the Site.

Article 2: Accessibility of the service
Harry Hope. is committed to using its best efforts and means to ensure the availability of this Site and its Services. 
However, Harry Hope. could not be held responsible for damages and/or prejudices, direct or indirect, of any nature whatsoever, resulting from possible errors, delays or technical incidents resulting from cases of force majeure, the failure of the User or a third party, without prejudice to the right to compensation of the User for cases where the unavailability would be attributable to Harry Hope. 
Harry Hope. declines, in particular, any responsibility in case of damage resulting from any access or impossibility of access to the Site, from the use of any information provided on the Site and, more generally, from any nonconforming and/or fraudulent use of the Site, whoever the person at the origin of it.

Article 3: Use of the Site by the Applicant
The Site allows the Candidate to consult job/collaborative offers and to submit his/her application (spontaneous application or response to published advertisements).
When applying, the Candidate voluntarily transmits his/her personal data (surname, first name, contact details, position sought, location) and has the possibility of attaching his/her CV and/or a message.

Harry Hope. receives applications and, if necessary, analyzes the CVs of candidates to put them in contact with potential Recruiters. For this purpose, Harry Hope. may contact the Candidate to confirm the information provided in the application and, if necessary, add it to its database in order to present its profile to potential Recruiters. 

In the event that an application may correspond to a desired profile, HARRY HOPE will forward the anonymized application to the Recruiter. This method contributes to the prevention of any risk of discrimination. 

HARRY HOPE. does not guarantee the Candidate the deadline for responding to applications, nor does it guarantee that Recruiters will respond to applications. Furthermore, Harry Hope. is not responsible for the pre-selection criteria or qualifications presented in the advertisements.

Article 4: Use of the Site by the Recruiter
The Site allows the Recruiter to publish job/collaboration offers via the "Recruiters' Area". On this occasion, the Recruiter transmits certain data (surname, first name, company, contact details, post sought, location) and has the possibility of attaching a message.

In the case that an application may correspond to a required profile, HARRY HOPE will transmit the anonymized application to the Recruiter. This method contributes to the prevention of any risk of discrimination. The terms of recruitment will be subject to general conditions accepted by the Recruiter.

Harry Hope. does not guarantee to the Recruiter the delay of response to the advertisements published on the Site. The service of Harry Hope. does not constitute any obligation of result. Harry Hope. does not guarantee to the Recruiter the transmission of applications in response to their offers. The responsibility of Harry Hope. could thus not be committed if no candidate is presented and/or retained during the final selection interviews.

Article 5: Customer service - Content of the site
Complaints concerning the relationship between Candidates and Recruiters are not admissible to HARRY HOPE.

Complaints concerning the use of the Site and/or the Service may be addressed to Harry Hope by e-mail at the following address: contact@harryhope.fr. Upon receipt, Harry Hope. is obliged to evaluate as soon as possible the admissibility of the complaint, and to bring an answer within two months. 

Harry Hope. endeavors to present updated information on its Site but does not make any representation, warranty or commitment as to the accuracy, timeliness or completeness of the information provided.

Article 6: Duration
The present GCU are concluded for an indefinite period of time as from the use of the Site by the User.

Article 7: Intellectual Property 
The copyright in any content provided on this website belongs to Harry Hope. or the third party owner of the content. Except as provided herein, no content from this website may be copied, reproduced, distributed, republished, downloaded, displayed, posted, transmitted in any form or by any means, including, but not limited to, electronic, mechanical, photocopying, recording, or otherwise, without the prior written permission of HARRY HOPE or the third party content owner. Unauthorized use of any content on this site may violate copyright laws, privacy and publicity regulations, communications regulations and laws and regulations, and other national and local laws. It is specified that the photos appearing on the Site are only descriptive and non-contractual.

8.1 Principle 
Harry Hope. commits itself to keep confidential all the information of which it would have had knowledge within the framework of the use of its Services by the Users and, to take all the measures, in particular of safety, necessary in order to ensure the respect of the integrity and the confidentiality of this information.  

In accordance with the legal and/or regulatory provisions relating to the protection of personal data, in particular the law n°78-17 of January 6, 1978 modified in 2018, and the (EU) regulation 2016/679, HARRY HOPE implements appropriate technical and organizational measures to protect the personal data processed against destruction, loss, alteration, disclosure or access to unauthorized third parties. 

HARRY HOPE. undertakes not to transfer this personal data outside the European Union for any reason whatsoever. 

The Recruiter undertakes the same obligations as Harry Hope. with regard to the protection of personal data of Candidates whose profiles may be communicated to him/her. 

Each of the Parties is committed to the respect of these obligations of confidentiality and protection of personal data, by all of its employees and any other person to whom it would have had the need to communicate information.

8.1 Personal data
Users of the Site are likely to communicate personal data subject to automated processing or not for the following purposes:

    The management of Candidates' files;
    The transmission of information on the offers and services of Harry Hope and/or its partners;
    The sending of information and alerts (new offers; new profile; etc).
    The use for statistical purposes of information related to navigation.  
To access the Services offered by the Site, any User voluntarily transmits data when requesting the publication of ads or when applying for a job. Any User thus authorizes Harry Hope. to contact him/her and to share this information with other Users as soon as this information is relevant and necessary for the realization of the purpose of putting Candidates and Recruiters in contact with each other.

For a Candidate, the information collected is, in particular: first and last name, email address, telephone number, location, position sought. The Candidate has the possibility to upload his/her CV and to leave a message.
Under these conditions, the Candidate authorizes Harry Hope. to contact him/her to acknowledge receipt of his/her application, to contact him/her to verify the information transmitted, to distribute his/her data to third party Recruiters who may be interested in his/her profile, to keep the information for the purposes of a future recruitment campaign.
For a Recruiter, the information collected is, in particular: surname and first name, company, contact details, post sought, location. The Recruiter may attach a message.
Under these conditions, the Recruiter authorizes Harry Hope. to contact him to acknowledge receipt of the advertisement, to contact him to verify the information transmitted, to distribute the advertisements on its site and to candidates likely to be interested in the advertisement, to keep the information for the purposes of a subsequent recruitment campaign.

No personal data is resold to other third parties.

The collected data are kept by Harry Hope. for a period of 2 years from the last contact. Beyond that, the data will be kept with your express consent.  

In accordance with the law "Informatique et Libertés" of January 6, 1978 modified in 2018, Harry Hope. guarantees to its Candidate Users a right of access, rectification, limitation, opposition, deletion and portability of their data. These requests must be addressed to the designated Personal Data Protection Officer (DPO): dpo@harryhope.fr or to the postal address: 16 rue de Malzéville 54130 Dommartemont.

8.2 Confidentiality
All information and data relating to Users, of whatever nature, is considered and treated as confidential (in particular information concerning Candidates). The User undertakes not to disclose all or part of the confidential information to third parties and not to use it for any purpose other than that for which it was collected.

8.4 Cookies
In order to improve the quality of its service and to better meet the expectations of its users, Harry Hope. may collect personal data on the user, including through the use of markers (cookies)
. The acceptance of these cookies is mandatory for any publication of an ad or application.  Cookies are small files that are deposited on the computer of the user of the Site for the sole purpose of facilitating his navigation on the Site and to personalize the service offered to him. 8.5 Hypertext links
The Site may contain hypertext links. The existence of a link from this Site to another site does not constitute a validation of this site or its content. The creation of hypertext links to the Site can only be made with the prior written authorization of Harry Hope .

Article 9: Transfers
Under no circumstances is the User permitted to assign or transfer in any manner whatsoever his or her rights or obligations under these TOU, unless Harry Hope. has expressly consented in writing to such assignment or transfer. 

Article 10: Applicable law - attribution of competence
The law applicable to the content and data transmission on and around the Site is French law. In case of dispute, the territorial jurisdiction is that of the headquarters of Harry Hope. (Nancy). In case of dispute, an amicable solution will be sought before any legal action. The Users can also address themselves to the Harry Hope. claims department at the address contact@harryhope.fr.
