Terms and conditions of use

Preamble

HARRY HOPE BELGIUM specializes in personnel search, selection, orientation and placement.

To support Recruiters in their recruitment process and Candidates in their job search, HARRY HOPE BELGIUM provides its users with the https://www.harry-hope.com/be/fr/ website.

These General Conditions of Use specify the conditions of use of the Site and the services offered by HARRY HOPE BELGIUM, regardless of the status of the User (Recruiter or Candidate).

For the purposes hereof, the following terms shall have the following meanings:

  • “User” refers to any person browsing the website and consulting the information published (Candidate and Recruiter);
  • “Candidate” means any person seeking employment;
  • “Recruiter” refers to any person and/or company wishing to publish information relating to job vacancies, on their own behalf or on behalf of third parties;
  • “Service” refers to the services used by Recruiters to put Recruiters in contact with Candidates, in particular by means of tools for publishing job advertisements, transmitting CVs, etc ;
  • “Site” means the Internet site accessible at https://www.harry-hope.com/be/fr/ and published by HARRY HOPE BELGIUM.

Article 1: Acceptance of the “GCU

By accessing the Site and using its services in accordance with these General Terms and Conditions of Use (hereinafter “GTCU”), the Visitor acknowledges having read these GTCU and agrees to abide by them without reservation.

These terms and conditions are subject to change, in particular to comply with any new legislative or regulatory provisions. Internet users (Visitors and Users) are therefore advised to refer regularly to the latest version of the “GCU”, which is permanently available on the Site.

Article 2: Service accessibility

HARRY HOPE BELGIUM undertakes to use its best efforts to ensure the availability of this Site and its Services.

However, HARRY HOPE BELGIUM shall not be held liable for any direct or indirect damages of any nature whatsoever resulting from any errors, delays or technical incidents resulting from force majeure, the failure of the User or a third party, without prejudice to the User’s right to compensation in cases where the unavailability is attributable to HARRY HOPE BELGIUM.

HARRY HOPE BELGIUM declines, in particular, all responsibility in the event of damage resulting from any access or impossibility of access to the Site, from the use of any information provided on the Site and, more generally, from any non-compliant and/or fraudulent use of the Site, regardless of the person responsible for such use.

Article 3: Use of the Site by the Candidate

The Site enables Candidates to consult job offers/collaboration opportunities and to submit their applications (unsolicited applications or responses to published advertisements).

When applying, Candidates voluntarily submit their personal data (surname, first name, contact details, position sought, location) and have the option of attaching their CV and/or a message.

HARRY HOPE BELGIUM receives applications and, if necessary, analyzes candidates’ CVs to put them in touch with potential Recruiters. To this end, HARRY HOPE BELGIUM may contact the Candidate in order to confirm the information provided in the application and add it to its database with a view to presenting the Candidate’s profile to potential Recruiters.

In the event that an application matches the profile sought, HARRY HOPE BELGIUM will forward the anonymized application to the Recruiter. This method helps prevent any risk of discrimination.

HARRY HOPE BELGIUM does not guarantee the Candidate a response time to applications, nor that Recruiters will respond to them. Furthermore, HARRY HOPE BELGIUM is not responsible for the pre-selection criteria or qualifications presented in the advertisements.

Article 4: Use of the Site by the Recruiter

The Site allows the Recruiter to publish job offers/collaboration via the “Recruiters’ Area”. On this occasion, the Recruiter transmits certain data (surname, first name, company, contact details, position sought, location) and has the option of attaching a message.

In the event that an application matches the profile sought, HARRY HOPE BELGIUM will forward the anonymized application to the Recruiter. This method helps prevent any risk of discrimination. The terms and conditions of recruitment will be subject to general conditions accepted by the Recruiter.

HARRY HOPE BELGIUM does not guarantee the Recruiter a response time to advertisements published on the Site. HARRY HOPE BELGIUM’s service does not constitute any obligation of result. HARRY HOPE BELGIUM does not guarantee the Recruiter the transmission of applications in response to their offers. HARRY HOPE BELGIUM cannot be held responsible if no candidate is presented and/or retained during the final selection interviews.

Article 5: Customer service – Site content

Complaints concerning relations between Candidates and Recruiters are not admissible by HARRY HOPE BELGIUM.

Complaints concerning the use of the Site and/or the Service may be addressed to HARRY HOPE BELGIUM by e-mail at the following address: contact.belgique@harry-hope.com. Upon receipt, HARRY HOPE BELGIUM undertakes to assess the admissibility of the complaint as soon as possible, and to respond within two months.

HARRY HOPE BELGIUM endeavours to present up-to-date information on its Site but makes no representations, warranties or undertakings as to the accuracy, currency or completeness of the information provided.

Article 6: Duration

These GCU are concluded for an indefinite period from the date of use of the Site by the User.

Article 7: Intellectual property

The copyright in any content provided on this website belongs to HARRY HOPE BELGIUM or the third party owner of the content. Subject to the provisions herein, none of the content of this website may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means, including, but not limited to, electronic, mechanical photocopying, recording or otherwise, without the prior written permission of HARRY HOPE BELGIUM or the third party owner of the content. Unauthorized use of any content on this site may violate copyright laws, the laws of privacy and publicity, communications regulations and statutes, and other national and local laws. It is specified that the photos appearing on the Site are only descriptive and non-contractual.

8.1 Principle

HARRY HOPE BELGIUM undertakes to maintain the confidentiality of all information of which it becomes aware through the use of its Services by Users, and to take all measures, in particular security measures, necessary to ensure the integrity and confidentiality of such information.

In accordance with legal and/or regulatory provisions relating to the protection of personal data, in particular Regulation (EU) 2016/679, HARRY HOPE BELGIUM implements appropriate technical and organizational measures to protect processed personal data against destruction, loss, alteration, disclosure or access by unauthorized third parties.

HARRY HOPE BELGIUM undertakes not to transfer personal data outside the European Union for any reason whatsoever.

The Recruiter undertakes the same obligations as HARRY HOPE BELGIUM with regard to the protection of the personal data of Candidates whose profiles may be communicated to it.

Each of the Parties is responsible for compliance with these obligations of confidentiality and protection of personal data by all its employees and any other person to whom it may need to communicate information.

8.2 Personal data

Users of the Site are likely to communicate personal data, which may or may not be processed automatically, for the following purposes:

  • Candidate file management ;
  • The transmission of information about offers and services from HARRY HOPE BELGIUM and/or its partners;
  • Sending information and alerts (new offers; new profile; etc).
  • The use of browsing information for statistical purposes.

To access the Services offered by the Site, all Users voluntarily transmit data when requesting the publication of advertisements or when applying for jobs. All Users hereby authorize HARRY HOPE BELGIUM to contact them and to share this information with other Users as long as this information is relevant and necessary for the purpose of putting Candidates and Recruiters in contact with each other.

For a Candidate, the information collected includes: first and last name, email address, telephone number, location, position sought. Candidates can upload their CV and leave a message.

Under these conditions, the Candidate authorizes HARRY HOPE BELGIUM to contact him/her to acknowledge receipt of his/her application, to contact him/her to verify the information transmitted, to distribute his/her data to third-party Recruiters likely to be interested in his/her profile, and to retain the information for the purposes of a subsequent recruitment campaign.

For a Recruiter, the information collected includes: first and last name, company, contact details, position sought, location. The Recruiter can attach a message.

Under these conditions, the Recruiter authorizes HARRY HOPE BELGIUM to contact him/her to acknowledge receipt of the advertisement, to contact him/her to verify the information transmitted, to distribute the advertisements on its site and to candidates likely to be interested in the advertisement, and to retain the information for the purposes of a subsequent recruitment campaign.

No personal data is sold to third parties.

The data collected is kept by HARRY HOPE BELGIUM for a period of 2 years from the last contact. Beyond that, data will be kept with your express consent.

In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, HARRY HOPE BELGIUM guarantees its Candidate Users a right of access, rectification, limitation, opposition, deletion and portability of their data. 8.3 Privacy policy

All information and data relating to Users, of whatever nature, are considered and treated as confidential (in particular information concerning Candidates). The User undertakes not to disclose all or part of the confidential information to third parties and not to use it for any purpose other than that for which it was collected.

8.4 Cookies

In order to improve the quality of its service and better meet the expectations of its users, HARRY HOPE BELGIUM may collect nominative data on the user, in particular through the use of markers (cookies). Acceptance of these cookies is mandatory for any publication of an advertisement or submission of an application. Cookies are small files deposited on the Site user’s computer for the sole purpose of facilitating navigation on the Site and personalizing the service offered. 8.5 Hyperlinks

The Site may contain hypertext links. The existence of a link from this Site to another site does not constitute an endorsement of that site or its content. Hyperlinks to the Site may only be created with the prior written authorization of HARRY HOPE BELGIUM.

Article 9: Transfers

The User is in no way authorized to assign or transfer in any way whatsoever its rights or obligations under these GCU, unless HARRY HOPE BELGIUM has expressly agreed to do so in writing.

Article 10: Applicable law – Jurisdiction

The law applicable to the content and transmission of data on and around the Site is Belgian law. In the event of a dispute, the courts of Brussels shall have territorial jurisdiction.
